1. Who we are, and what this is
The Leaf Guide (“the Service,” “we,” “us”) is an education, culture, and community-review platform about cannabis, operated by Khari Day as an individual (operator identity will be updated upon formation of the operating LLC). These Terms govern your use of theleafguide.com.
We sell nothing. The Service offers no products, processes no payments, and does not facilitate, broker, or arrange the purchase, sale, or delivery of cannabis or any other product. It is an information and community platform only.
2. Eligibility — adults 21+ only
You must be at least 21 years old to use the Service. Creating an account requires an affirmative attestation that you are 21 or older, which we store with a timestamp. We may suspend or terminate any account we reasonably believe belongs to a person under 21.
3. Not advice
Content on the Service — including articles, reviews, ratings, and community reports — is educational and opinion content. It is not medical, legal, or professional advice, and it is not a statement that any product is safe, effective, or lawful for you. Cannabis laws vary by jurisdiction; you are responsible for knowing and following the laws where you live.
4. Your account
You are responsible for your account and for keeping your credentials secure. One person, one account. You may not sell, share, or transfer an account. We may require you to change a handle that is misleading, infringing, or offensive.
5. Your content and our license (UGC)
You own the reviews, reports, comments, and other content you post (“User Content”). By posting, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (for formatting and display), publish, and distribute your User Content in connection with operating and promoting the Service. This license survives for as long as the content remains on the Service and for a reasonable period needed for backups and legal compliance.
You represent that your User Content is your own honest experience or opinion, that you have the rights to post it, and that it doesn’t violate law or these Terms.
6. Community reviews and authenticity reports are opinion
All ratings, reviews, and shop authenticity reports on the Service are statements of individual community members’ opinions and personal experiences. They are not statements of fact by The Leaf Guide. We do not inspect, test, verify, or certify any product, brand, or shop. “Community Verified” and similar designations mean only that a threshold number of member reports has accumulated; an “Unverified” designation means only that such reports have not yet accumulated, and is not a negative statement about any business.
If you believe a report about you or your business is false or posted in bad faith, contact us at contact@theleafguide.com and we will review it under our moderation policies.
7. Prohibited content and conduct
You agree not to post or do any of the following:
- Offer to buy or sell cannabis or any other product, or use the Service to arrange a transaction of any kind;
- Post content you know to be false, or reviews of products or shops you have not actually experienced;
- Post reviews or reports about a business you own, work for, or compete with without disclosing that relationship where prompted;
- Manipulate ratings or verification — including coordinated voting, multiple accounts, purchased reviews, or automation;
- Harass, threaten, or defame any person or business, or post content that is unlawful, infringing, or hateful;
- Post content involving anyone under 21;
- Scrape, harvest, or bulk-export Service content or member data without our written permission.
8. Moderation and removal — our rights
We may remove, hide, edit the display of, or decline to publish any User Content, and may suspend or terminate any account, at any time, at our sole discretion, with or without notice — including for violations of these Terms, suspected manipulation, legal risk, or no stated reason. We may preserve and disclose content and account information where we believe in good faith the law requires it. We have no obligation to store or return User Content after removal or account closure.
9. Intellectual property
The Service’s own content, design, and branding are ours and protected by law. We welcome linking to our pages; you may not copy our content at scale or imply endorsement without permission. To report content you believe infringes your copyright, email contact@theleafguide.com with the details required by the DMCA.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY COMMUNITY CONTENT IS ACCURATE OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
12. Indemnification
You will defend and hold us harmless from claims and costs (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or the law.
13. Disputes — binding arbitration and class waiver
Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in [VENUE — pending legal review], rather than in court, except that either party may bring an individual claim in small claims court. You and we each waive the right to a jury trial and to participate in a class action.
You may opt out of this arbitration provision by emailing contact@theleafguide.com within 30 days of first accepting these Terms, with your account handle and a clear opt-out statement.
14. Governing law
These Terms are governed by the laws of the State of [STATE — pending legal review], without regard to conflict-of-laws rules.
